1. Why trial operation is required after the environmental permit
Trial operation of waste treatment works after the environmental permit is granted is a mandatory requirement under the Law on Environmental Protection 2020. Specifically:
Under Clause 26, Article 3 of the Law on Environmental Protection 2020, 'trial operation of waste treatment works means operation to test and evaluate the effectiveness and conformity with environmental protection requirements of the waste treatment works of investment project owners, facilities, concentrated production, business and service zones, and industrial clusters.'
Under Decree 08/2022/ND-CP, apart from certain exceptions, all projects that have been granted an environmental permit must comply with the regulations on trial operation of waste treatment works.
Article 46 of the Law on Environmental Protection 2020 regulates the trial operation of waste treatment works after the environmental permit is granted for the following works:
- Waste treatment works: works and equipment for treating wastewater, dust, exhaust gas, solid waste and hazardous waste;
- Solid waste collection and storage works: works and equipment for collecting and storing ordinary solid waste, medical solid waste and hazardous solid waste to meet requirements for sorting, collection, storage, reuse, recycling and transport of solid waste to treatment, reuse or recycling sites;
- Other environmental protection works.
2. Regulations on the trial operation period after the environmental permit
The trial operation period of waste treatment systems is set out in Clause 6, Article 31 of Decree 08/2022/ND-CP as follows:
3 to 6 months for projects that are concentrated production, business and service zones, industrial clusters, or investment projects in production, business and service types with a risk of causing environmental pollution at large capacity as specified in Column 3, Appendix II issued with this Decree;
For other projects, the trial operation period is decided by the investment project owner, who bears responsibility for it, but must not exceed 6 months and must allow the effectiveness of the waste treatment works to be evaluated as required;
If the trial operation needs to be extended, the investment project owner must issue a written notice stating the reason, and the extension must not exceed 6 months. For large-scale projects invested in phases, the operation period may be extended according to the licensing authority's regulations.
