Environmental Permit Application Services in Binh Duong
Hello, I own a workshop that manufactures all kinds of packaging in Song Than 1 Industrial Park, Binh Duong Province, and it generates wastewater and exhaust gas. In 2021 the workshop's environmental impact assessment was approved by the Industrial Zones Management Board. I understand that since 2022 companies that generate waste must obtain an environmental permit, but I am not sure whether my workshop needs an environmental permit in Binh Duong. If so, what do I need to prepare and where do I submit it? Thank you very much!

1. What is an environmental permit?
First introduced in Law on Environmental Protection No. 72/2020/QH14, the environmental permit is a document issued by a competent state authority to projects that discharge waste into the environment. It is a tool that allows authorities to supervise and inspect the environmental protection activities of businesses.
Also under the Law on Environmental Protection 2020, the 7 former component environmental licenses (permit to discharge wastewater into water sources, permit to discharge wastewater into irrigation works, certificate of completion of environmental protection works, certificate of eligibility for environmental protection in importing scrap as production material, industrial emission discharge permit, hazardous waste generator registration book, and hazardous waste treatment permit) have been integrated into a single permit: the Environmental Permit.

2. Who needs to apply for an environmental permit in Binh Duong?
Pursuant to Article 39 of the Law on Environmental Protection 2020:
- Group I, Group II and Group III investment projects that generate wastewater, dust or exhaust gas discharged into the environment that must be treated, or generate hazardous waste that must be managed under waste management regulations, when they enter official operation.
- Investment projects, facilities, concentrated production, business and service zones, and industrial clusters operating before 01/01/2022 that meet the same environmental criteria as Group I, Group II and Group III investment projects generating wastewater, dust or exhaust gas that must be treated, or hazardous waste that must be managed;
- Entities specified in Clause 1 of this Article that are urgent public investment projects under public investment law are exempt from the environmental permit.
In addition, to determine whether your project is required to obtain an environmental permit, your business needs to consider factors such as:
- Does the investment project involve environmentally sensitive factors?
- Is the project located inside or outside an industrial park?
- Has the project started operation?
- Does it have waste/wastewater treatment works?
- Has the investment project's environmental impact assessment (EIA) appraisal result been approved?
3. Reviewing Ms. Hanh's case
Business line: Manufacturing of all kinds of packaging;
Waste generated: Wastewater, exhaust gas;
Considered by project scale.
- The project has been granted an EIA approval decision by the Binh Duong Industrial Zones Management Board.
- Under the Law on Environmental Protection 2020, a project whose EIA was approved at the Management Board level -> must obtain its environmental permit from the Industrial Zones Management Board before the project enters trial operation and operation.
It can therefore be concluded that Ms. Hanh's project is required to obtain an environmental permit in Binh Duong, under the licensing authority of the Binh Duong Industrial Zones Management Board.

(Clause 1, Article 43 of the Law on Environmental Protection 2020)

- An application letter for the environmental permit;
- The environmental permit application report;
