2. Key information about environmental registration
Who must register
According to Clause 1, Article 49 of the Law on Environmental Protection 2020, the following are subject to environmental registration:
a) Investment projects that generate waste and are not required to have an environmental permit;
b) Production, business and service facilities that were operating before this Law took effect, generate waste and are not required to have an environmental permit.
Contents of environmental registration
According to Clause 4, Article 49 of the Law on Environmental Protection 2020, environmental registration covers:
- General information about the investment project or facility;
- Type of production, business or service; technology, capacity, products; raw materials, fuels and chemicals used (if any);
- Types and quantities of waste generated;
- Plans for the collection, management and treatment of waste in accordance with regulations;
- Commitment to carry out environmental protection work.
Currently, under Resolution No. 66.19/2026/NQ-CP, investment projects and facilities subject to environmental registration shall register as follows:
- Investment projects and facilities discharging wastewater that must be treated with a total flow of 50 m³/day or more, or discharging dust and exhaust gas that must be treated with a total flow of 20,000 m³/hour or more, shall register with the provincial People's Committee;
- Investment projects and facilities whose wastewater and exhaust gas discharge flows requiring treatment do not fall under point a of this clause shall register with the commune-level People's Committee.
